Terms of Service for Bue

These Terms of Service ("Terms") govern your use of the Bue Discord bot ("the Bot"), provided by Juwen Yuvraj Nagpal, located in Germany. By adding the Bot to your Discord server or interacting with it in any way, you agree to be bound by these Terms.

1. Acceptance of Terms

By using the Bot, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy. If you do not agree with any part of these Terms, you must not use the Bot.

2. Bot Functionality

The Bot is designed to provide logging services and analytics for your Discord server. This includes, but is not limited to, logging messages, user activity, and server events, and providing analytical insights based on this data.

3. Data Collection and Usage

The Bot collects and stores data necessary for its logging and analytics functions. This may include:

• Message content: For logging purposes, but only as configured by server administrators.
• User IDs and usernames: To identify users associated with logged events.
• Server IDs and channel IDs: To identify the origin of logged data.
• Timestamps: To record when events occurred.

All data collected is stored securely and is used solely for the purpose of providing the Bot's services. We do not sell or share your data with third parties, except as required by law. For more detailed information on data collection, storage, and your rights, please refer to our Privacy Policy.

4. Permitted Use and Prohibitions

You agree to use the Bot only for its intended purpose of legitimate server administration, logging, and analytics. You are strictly prohibited from using the Bot for:

• Malicious Purposes: Any activity intended to harm, harass, or disrupt other users, servers, or Discord's services.
• Illegal Activities: Any activities that violate applicable laws and regulations, including but not limited to, those concerning child exploitation, hate speech, or harassment.
• Gambling: Facilitating, promoting, or engaging in any form of unauthorized gambling.
• Spamming or Flooding: Sending unsolicited messages or excessive, repetitive content.
• Harassment or Bullying: Engaging in any conduct that is abusive, threatening, defamatory, or otherwise harmful to others.
• Unauthorized Access: Attempting to gain unauthorized access to any system or data.
• Circumventing Security: Bypassing or attempting to bypass any security measures of the Bot or Discord.

Any violation of these prohibitions will result in immediate and permanent banning of the associated server and its owner from using the Bot, and may lead to further action, including reporting to Discord and relevant law enforcement authorities.

5. Server Owner Responsibilities

As a server owner, you are responsible for:

• Compliance: Ensuring that your server's use of the Bot complies with these Terms and all applicable laws.
• User Consent: Informing your server members about the Bot's presence and its data collection activities, and obtaining any necessary consents as required by privacy laws.
• Configuration: Properly configuring the Bot's logging settings to respect user privacy and server rules.
• Account Security: Maintaining the security of your Discord account and server, and promptly reporting any unauthorized use of the Bot.

6. Disclaimer of Warranties

The Bot is provided "as is" and "as available" without any warranties of any kind, either express or implied, including but not limited to, implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Bot will be error-free, uninterrupted, or secure.

7. Limitation of Liability

To the maximum extent permitted by German law, in no event shall Juwen Yuvraj Nagpal be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the Bot; (b) any conduct or content of any third party on the Bot; or (c) unauthorized access, use, or alteration of your transmissions or content.

8. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Germany, without regard to its conflict of law principles. Any legal action or proceeding arising under these Terms shall be brought exclusively in the courts located in Hamburg, Germany.

9. Changes to Terms

We reserve the right to modify or update these Terms at any time. We will notify you of any significant changes by posting the new Terms on the Bot's changelog at bueapp.xyz/changelog. Your continued use of the Bot after such modifications will constitute your acknowledgment of the modified Terms and agreement to abide and be bound by the modified Terms.

10. Termination

We may terminate or suspend your access to the Bot immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the Bot will immediately cease.
